TERMS AND CONDITIONS

Welcome to Yann Lemieux's online shop (hereafter: the "Site")

Please read the following terms and conditions carefully, as they bind you to the Merchant, the owner of the Site. Furthermore, you agree to communicate with the Merchant electronically for all your exchanges and that these exchanges meet all the requirements of a written communication.

We reserve the sole discretion to refuse service, cancel an order, terminate your account, remove or edit content from the Site or cancel an order whether or not you have complied with these Terms and Conditions.

CONFIDENTIALITY OF PERSONAL INFORMATION

Please see our privacy policy in the footer of our site for information on how we collect, share and manage your personal information.

The products and services offered are intended to be sold to adults who have reached the age of majority in your place of residence, i.e. 18 years old in the province of Quebec. By using the Merchant's Site you represent and warrant that you are of the age of majority in your place of residence.

ACCURACY OF INFORMATION

We make every effort to ensure that all information on our Site is error-free, but we cannot guarantee this. We may refuse or cancel an order containing an item with an incorrect description or price. Unless otherwise stated, prices are quoted in Canadian currency.

The products offered on our Site as well as the dates of offers, prices and availability, features and technical specifications of these products are subject to revision and change without notice. It is possible that a product ordered online is no longer available in our inventory or that it cannot be delivered due to a situation beyond our control. We will then proceed to cancel the order and refund the money paid in return, if this is the case.

Your only recourse in the event that a product is not as described is to return it in its original packaging for a refund in accordance with the refund provisions below.

REGISTRATION AND PASSWORD

You will be required to complete a registration form to access certain parts and features of the Merchant Site. You agree to provide us with current and truthful information and to keep this information current at all times.

You agree to protect the confidentiality of your user name and password and access to your computer so that no one else may use it. You are responsible for all transactions that occur under your account using this information. You shall notify us immediately of any unauthorised use of your username and password and any breach of security of which you are aware within forty-eight (48) hours of becoming aware.

COMMENTS

You may post comments and reviews about the content of the Site. You are entirely responsible for the comments you post, we are not responsible for them and you agree to indemnify the Merchant against any damages arising from them.

You may not post on behalf of others, conceal your identity, or post anything that is unlawful, obscene, threatening, defamatory, invasive of another's privacy or intellectual property, or constitutes chain letters, junk mail or spam.

We reserve the right, but not the obligation, to edit or remove comments without explanation, and we assume no responsibility for the systematic review of published material.

When you post a comment, you grant the Merchant a non-exclusive, royalty-free, perpetual and irrevocable right to use the name and content posted, to reproduce, modify, adapt, publish, perform, translate, broadcast, communicate to the public and display it anywhere in the world in any medium.

We ask that you post only one review per product, unless you wish to add new information. You agree to review only products that you have personally purchased and to maintain a respectful tone at all times. It is forbidden for employees and competitors of distributors and manufacturers to post reviews.

APPLICABLE LAWS

These terms and conditions shall be governed by the laws of the province or state of Quebec or the country of Canada applicable thereto. In addition, any legal action against the Merchant must be brought in the judicial district in which Quebec City is located.

 

ORDERING ERRORS

In the event that you believe that an error has occurred during the placement of an order, we invite you to notify us without delay, but at the latest within 48 hours of its discovery, by sending us a message to the following address: info@yannlemieux.com and indicating in sufficient detail the error that has been made

LIMITATION OF WARRANTY

SUBJECT TO APPLICABLE LAW, THE MERCHANT DISCLAIMS ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, AS TO THE TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PRODUCTS AND SERVICES SOLD ON THE SITE. IT ALSO DISCLAIMS ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED, IN THE CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR THROUGH THE SITE AND ON ITS SERVERS AND IN ELECTRONIC COMMUNICATIONS.

LIMITATION OF LIABILITY

THE MERCHANT SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, RESULTING FROM THE USE OR MISUSE OF THE SITE OR FOR THE PURCHASE OF GOODS THEREON INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFIT, USE OF DATA OR OTHER INTANGIBLES, EVEN IF THE MERCHANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The copyrights and trademarks contained in the information published on the Site are protected by intellectual property laws and are made available on the Site by the granting of a specific license in this regard.

In accordance with applicable intellectual property laws, you may not use, display or exhibit any trademarks, copyrights or other proprietary works available on the Site for any purpose other than to conduct the sale of such products and services without the right to sublicense to third parties. The owners of the marks appearing on the Site retain all rights not expressly granted in these Terms and Conditions.

If you have reason to believe that the Terms and Conditions have been violated or if your work has been copied or is being used on our Site in a way that infringes your intellectual property rights, please notify us as soon as possible by sending a message to info@yannlemieux.com with sufficient details of the infringement.
